Policies

By completing a reservation for Pembroke Springs Retreat (“PSR”), you, any other persons joining the reservation, and any visitors during your stay (collectively “Guests”) acknowledge that you have read, understand, and agree with the following policies, terms, and conditions. If minors are included among Guests, you assume responsibility for such persons and their adherence and agreement to policies, terms, and conditions set within. PSR reserves the right, at our discretion, to change and or modify portions of these terms and conditions at any time without notice and, unless otherwise indicated, such changes will become effective immediately upon posting to the PSR website.

Arrival and Departure Times:

Guest arrival/check in time is between 3:00PM and 7:00PM. Guests shall inform PSR of their specific arrival time prior to arrival to arrange for a check-in and orientation by staff. Departure/check-out time is 11:00AM.

Japanese Baths:

The use of the Japanese baths is not recommended for pregnant women, the elderly, persons in poor health, or under the influence of drugs or alcohol. Guests that use the baths acknowledge that they are in good health, have read and understand the warnings and regulations posted at the baths, and willingly assume full responsibility for all risks associated with the use of all facilities at PSR.

Pets:

PSR does not allow pets of any kind. If Guests bring any pets to the property, Guests shall pay a $500 pet cleaning fee, have their reservation cancelled, and depart the property immediately without any refund.

Smoking and open flames:

Smoking or vaping of any substance is prohibited indoors. Smoking or vaping is permitted outside. Cigarette butts must be disposed of safely. Open flames, including firecrackers, and fires of any kind are prohibited both indoors and outdoors. If Guests smoke or vape indoors, or light any prohibited fires anywhere on the property, Guests shall pay a $500 fee, have their reservation cancelled, and depart the property immediately without any refund.

Disturbances and Privacy:

Guests shall refrain from creating loud noises (e.g. playing very loud music) outside the building that may disturb the residents of the property and the natural environment (with the exception of events coordinated with PSR such as weddings, etc.). Gatherings of unregistered persons, open-invitation parties, and any other such gatherings that may create disturbances are prohibited (i.e. the guesthouse is NOT a party house). Vehicles must be parked in designated spaces without impeding the exit lane. Guests shall refrain from taking photographs or video of PSR staff and residents, or posting such photographs or video to social media, without prior permission. Flying drones on the property without prior permission is prohibited.

Damage:

Guests shall report damage to any PSR property, including, but not limited to, damaged or broken items, appliances, decorations, fixtures, stains, wall markings, technology, etc., caused by Guests to PSR staff immediately. Charges for damages or loss of items may be assessed by PSR and shall be paid by Guests.

Prohibited Areas:

Guests are prohibited from entering and using certain areas at PSR as indicated by staff orientation, signage, and locked doors. Prohibited areas include the laundry, storage, and utility rooms, as well as the Floyd family residences.

Personal Services:

PSR is not responsible for the performance of services from outside providers arranged by PSR as requested by Guests (including, but not limited to services such as massages or caterers). Payment of such services are the responsibility of the Guest directly to the service provider.

Security Cameras:

PSR has motion detecting security cameras on the property that may be in operation during Guests’ stay, including one in the office of the guesthouse building.

Weapons, Firearms, and Dangerous Materials:

Weapons, firearms, and dangerous materials of any kind are prohibited on the property. If Guests possess any of these prohibited items while on the property, Guests shall have their reservation cancelled and depart the property immediately without any refund.

Cancellations and Refunds:

Guests shall be charged a non-refundable deposit for their reservation by PSR.

For cancellations by Guests received by PSR ten (10) days or more prior to the arrival date of the reservation, deposits may be transferred to a future reservation. For cancellations received by PSR within ten (10) days of the arrival date of the reservation, deposits shall be forfeited and non-transferable. Guests may transfer the reservation to another party with notification to PSR. Cancellations by Guests must be made via email to PSR at pembrokespringsretreat@gmail.com by the party who made the reservation.

LIABILITY AND RISKS:

Under Virginia law, there is no liability for an injury to or death of a participant in an agritourism activity conducted at this agritourism location if such injury or death results from the inherent risks of the agritourism activity. Inherent risks of agritourism activities include, among others, risks of injury inherent to land, equipment, and animals, as well as the potential for Guests to act in a negligent manner that may contribute to your injury or death. Guests are assuming the risk of participating in this agritourism activity.

PSR and its owners allow Guests the use of the PSR guesthouse and amenities and may also allow for the use of amenities and activities (e.g. baths, tennis court, hiking trails, fishing pond) on adjacent properties owned by Pembroke Springs Retreat, LLC members. Guests acknowledge and understand that there are dangers and risks associated with use of the aforementioned properties and services and amenities offered on such properties, including but not limited to: unstable, uneven, or slippery surfaces; fallen or hanging trees or branches; animals and insects, domesticated and wild, including unleashed pets, honeybees, and venomous snakes; out buildings and other structures that may be in disuse or disrepair, including footbridges, animal pens, cabins, hunting stands and blinds, docks, treehouses, decks, railing, and fencing; vehicles and boats; gardening, landscaping, and farming tools, equipment, chemicals, and machinery; any food or beverage service, both paid and complimentary; kitchen use and equipment; maps or other information provided by PSR created in good faith that may be outdated or have incorrect information. Guests shall hold harmless and indemnify the owners and members of Pembroke Springs Retreat, LLC, their family members, or the owners of adjacent property against any claims resulting from the use of PSR, adjacent properties, or the use of services and amenities on such properties.
